The Plaintiff was taken to the Hospital where it was confirmed that he sustained a fracture to the twelfth thoracic vertebrae. The Plaintiff underwent a CT scan of the brain, cervical spine, and pelvis which revealed spinal stenosis at T11/T12 level of his spine.
MRI scans of the cervical, thoracic and lumbar spine showed some disc hernia erosion at C5/C6 and C6/C7 levels with stenosis of the spinal cord.
He required surgery, extensive rehabilitation and pain management.
Due to the significance of the accident, the Injuries Board advised that they were not in a position to assess the case.
Accordingly, proceedings were initiated and the matter was compromised directly with the Insurance Company for the rented vehicle.
