Personal Injury cases can be complicated and difficult to navigate, but one publication that has become essential in determining appropriate compensation in Ireland is the Book of Quantum. 


What is the Book of Quantum?

The Book of Quantum is an important publication in Ireland that provides guidelines for compensation payments in Personal Injury cases. 

It is used by judges and legal professionals to help determine the appropriate amount of compensation that should be awarded to victims of Personal Injury.

By providing a framework for assessing the severity and impact of different types of injuries, it aims to create a consistent and transparent approach to compensation awards, while also allowing for flexibility to account for the unique circumstances of an individual case.

It takes into account a range of factors such as:

  • the area(s) of the body injured,
  • the severity of the injury, 
  • the victim's gender, age and occupation, 
  • the impact of the injury on the victim's life
  • past and future loss of earnings
  • cost of medical care and medical bills

Note: The Book only reflects compensation for pain and suffering which is supported by appropriate medical evidence.

The Book was created by the Personal Injuries Assessment Board (PIAB) – an independent statutory body established by the Irish government in 2003 to assess Personal Injury compensation claims. 

It was first published in 2004 and is updated periodically to reflect changes in compensation laws and court decisions.


How is the Book of Quantum used?

When making a Personal Injury claim, the Book of Quantum can be used as a guide for valuing a Personal Injury claim.

The recommended steps to be followed are:

  1. Identify a category of injury
  2. Understand the severity of the injury
  3. Look up the value range
  4. Consider the effect of multiple injuries

How to use The Book of Quantum

Note: It is important to note that the Book of Quantum is a guide and not a strict rulebook. Compensation amounts may vary depending on the specific circumstances of each case, and negotiation between the parties involved is common in Personal Injury claims.

Considering special circumstances: 
The compensation ranges provided in the Book of Quantum are intended to be a starting point for negotiations, and may not be suitable for all cases. If there are any special circumstances or factors that may affect the compensation amount, such as future loss of income, care needs or ongoing medical expenses, these should also be taken into account.


1. Identifying the category of Injury

The first step is to determine the category of injury by identifying the part of the body that has suffered the most significant injury.

The Book is divided into six categories:

  • Head 
  • Neck 
  • Back and spinal
  • Upper limbs
  • Lower limbs
  • Body and Internal Organs

 

Identifying the category of Injury

The complete effect of all the injuries is also a consideration.

Just some of the types of injuries covered by the Book of Quantum include:

  • Soft tissue injuries: 
    These include injuries to muscles, tendons, and ligaments, such as sprains, strains, and whiplash.
     
  • Fractures: 
    The guidelines provide compensation ranges for various types of bone fractures, such as wrist, ankle, and leg fractures.
     
  • Head injuries: 
    The Book of Quantum includes guidelines for assessing compensation for fractures, concussions, and traumatic brain injury, as well as other head injuries such as eye injuries, hearing, facial and dental injuries etc.
     
  • Neck injuries: 
    Injuries such as whiplash [link to our Whiplash page] and soft tissue damage typically arising from road traffic accidents and slip/trip/fall types of accidents.
     
  • Back injuries and Spinal Fracture: 
    The guidelines cover injuries to the spinal cord, such as herniated discs and spinal fractures. Paralysis of all four limbs, loss of sexual function or loss or impairment of urinary or bladder function are also addressed.
     
  • Upper Limb Injuries
    Includes guidelines on the loss of arm or hands and loss of single or multiple digits. Soft tissue damage to the shoulder/upper arm, dislocation, fractures, clavicle injuries and crush injuries are addressed.
     
  • Lower Limb Injuries
    Loss of legs, feet or toes. Damage to the hip and pelvis including dislocations and fractures. Knee sprain and soft tissue damage to the knee. Lower leg fractures of the tibia and fibula. Foot sprains (acute and chronic) and crush injuries. Toe dislocation and fractures are also covered.
     
  • Body and Internal Organs
    Injuries to the rib(s) or chest including fractures, heart contusion, lung injuries, kidney injuries such as contusions, lacerations, haematomas and ruptures. Damage to the bowels and digestive system including lacerations, bruising, colostomies etc. Bladder injuries, damage to the spleen, hernias, and food poisoning are also covered.

These are just some examples of the types of injuries covered by the Book of Quantum. The guidelines also take into account the severity and duration of the injury, as well as the impact it has on the individual's life and ability to work. 


2. Identifying the category of Injury

The Book of Quantum categorises injuries into four bands, based on their severity and the impact they have on an individual's life. 

  • Minor Injuries 
  • Moderate
  • Moderately Severe
  • Severe and Permanent Conditions

Each band contains a range of compensation values for different types of injuries within that band, with the compensation amount determined based on the specific circumstances of the case, such as the severity of the injury and its impact on the individual's life. 

Identifying the category of Injury

Minor Injuries: 
These are injuries that have substantially recovered and cause minimal disruption to the individual's life. They typically heal within a few weeks or months. Examples of minor injuries include sprains, strains, and minor cuts and bruises.

Moderate Injuries: 
When a claimant has substantially recovered but experienced ongoing symptoms that interfere with day-to-day activities, they are said to be suffering from moderate injuries. These injuries cause more significant disruption to the individual's life than minor injuries and may take several months or years to heal. Examples of moderate injuries include more serious fractures, injuries that require surgery, and injuries that cause scarring or disfigurement.

Moderately Severe
Where a claimant experiences incapacity or limitation that impacts the injured body part. Examples of moderately severe injuries include broken bones, head injuries, soft tissue injuries, spinal injuries and amputations.

Severe and Permanent Conditions
These are injuries that have a long-term or permanent impact on the individual's life and may require ongoing medical care and support.  Serious continuing pain and/or permanent medical attention is said to be a major disruption to a claimant's life. Examples of severe injuries include traumatic brain injury, spinal cord injury, and loss of limb or sight.


3. Look up the value range

Once an injury category and severity have been identified, the Book is used to find the estimated compensation range of an injury. The Book provides a range of values for each type of injury within each band, taking into account the severity and impact of the injury on the individual's life.  

Although the majority of cases fall within the compensation range, it is not a minimum or maximum figure.

The value range is usually presented as a monetary value or a range of values, representing the recommended compensation amount for that particular injury and severity.

It is important to note that these guidelines are not legally binding but rather act as a guide to the parties involved including the judiciary. Judges may use their discretion to adjust compensation amounts based on the specific circumstances of each case.


4.  Accounting for multiple injuries (Consider the effect of multiple injuries)

In the event of multiple injuries, the Book of Quantum provides guidance on how to calculate the total compensation amount that should be awarded to the victim. 

In the event a claimant has sustained multiple injuries, it is not appropriate to locate each category in the book and simply total up the respective values for each type of injury.

Instead, the most significant injury must be identified and then used to determine the range of value that applies to you. 

The additional injuries sustained may result in a minor adjustment within the value range that applies to your most significant injury.

Q: Who is the Book of Quantum created for?
