Joel Gannon was just over two years old when he caught his head in the electric gate outside his home. When the gate closed, he was dragged along the ground, suffering a fractured shoulder and scratches to the left side of his face. His dad was close by and was able to free Joel quickly.
Joel’s mother, Lyndsay, made a claim for compensation against the housing association responsible for her family home and Dublin City Council. Lyndsay alleged that the gate should be covered with metallic netting to prevent such accidents occurring.
Liability was contested but a compensation offer of €19,000 was made and Joel’s mother, Lyndsay, accepted on behalf of her son (now aged 9).
At the approval hearing, Mr. Justice Raymond Groarke approved the settlement, after hearing that Joel had made a full recovery.
