Salmovir Spes hurt his back in October 2011 while lifting a tray of yoghurts from a pallet while working at the Windcanton Distribution Centre in Blanchardstown Dublin. As he turned with the tray of yoghurts he felt a sharp pain in his back. He went home and then sought medical attention. He was unable to work and was on sick leave until 2014, when he was made redundant.
At the High Court hearing of his case recently, Mr. Justice Anthony Barr found that Mr. Spes’ injury was due to a number of factors, lack of adequate training, high targets and having to take short cuts to reach his targets.
Judge Barr awarded Mr. Spes €153,500 compensation for his workplace injury due to his employer’s negligence which rendered him not only permanently disabled in relation to work but in severe pain in relation to day to day activities.
